1) GENERAL CONDITIONS
- The following general terms and conditions govern all online purchases made through the website https://www.organictruffles.it.
Purchasing transactions through the Site are reserved for consumers, namely individuals of legal age who act for purposes unrelated to any commercial, craft, business, or professional activity they may engage in.
Before making a purchase, the Customer is required to carefully read these conditions, which are available on the Site and can be saved or printed for future reference. Furthermore, they will be sent to the Customer by email at the time of the order. Contracts concluded with Customers will be archived by Organic Truffles and accessible through the Customer’s account.
Contracts concluded with Organic Truffles through the Site are governed by Italian law, the Consumer Code (Legislative Decree 6 September 2005, no. 206), and the E-commerce Decree (Legislative Decree 9 April 2003, no. 70).
After receiving the information provided by the data controller pursuant to art. 13 of Legislative Decree 196/2003, the Customer consents to the processing of their personal data for the purposes indicated in the information, necessary to allow the Owner a proper management of the relationship and adequate data processing.

03) PRODUCTS AND AVAILABILITY
The images of the Products on the Site are purely indicative and may differ from the actual Product delivered, including differences in packaging. The information provided on the Site regarding the Products may be subject to changes and updates by the Seller.
04) ORDERS
To place a purchase order through the Site, the Customer must follow the online purchase procedure provided. It is specified that adding a Product to the cart does not constitute an actual purchase order but only a purchase proposal.
Before confirming the order, the Customer will have the opportunity to verify and modify the details of the order, including the selected Products, the desired quantity, and the shipping address. Upon confirmation of the order, the Customer agrees to purchase the Products at the indicated price, including any applicable taxes and shipping costs.
05) PRICES AND PAYMENT
The prices of the Products are indicated on the Site and are expressed in Euros (€). The prices included on the Site are valid at the time of the order and are subject to changes without notice. Any discounts or promotions will be applied at the time of purchase.

06) SHIPPING AND DELIVERY

The Seller commits to delivering the Products as soon as possible; however, delivery times may vary depending on the destination and any unforeseen circumstances. The Seller will not be responsible for any delays in the delivery of the Products.
07) RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the purchase within 14 days from the delivery of the Products. To exercise the right of withdrawal, the Customer must send written communication to the Seller within the 14-day period.
The Customer will be responsible for the costs of returning the Products unless otherwise indicated by the Seller or in the case of defective or incorrect Products. Once the returned Products are received, the Seller will proceed to refund the price paid by the Customer within 14 days.

The Seller commits to responding to Customer inquiries as quickly as possible.
09) PRICE
The prices of the products on the Site are expressed in Euros and include applicable taxes. Delivery charges will be added, if applicable, to the price of the products and clearly indicated in the order form.
The Seller constantly checks the accuracy of the prices indicated on the Site but cannot guarantee the absence of errors. In case an error in the price of a product is detected, the customer will be offered the option to confirm the order at the correct price or cancel it.
The information on the Site does not constitute an offer by the Seller.
10) PURCHASING METHODS
The essential characteristics and prices of the products are indicated in the offers related to each product on the Site.
Before sending a purchase proposal, customers are invited to read and understand the instructions provided during the purchase procedure and these General Conditions, as they will become binding once the contract is concluded. To purchase products, the customer must fill in and submit the order form in electronic format, following the instructions on the Site. The customer must add the product to the “cart” and, after having viewed and accepted the General Conditions, especially regarding the contribution for delivery costs, if provided, and the withdrawal conditions, as well as having viewed the Privacy Policy, must select the desired payment method and choose the “proceed with the order” option.
If the customer needs to correct any data entry errors, they must follow the modification procedure indicated on the Site before submitting the order proposal. In particular, the customer has the possibility to change the quantity of products to be purchased, adding or removing products from the “cart”.
By sending the order proposal to the Seller, the customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these General Conditions.
11) PAYMENT AND SHIPPING
The customer can make the payment for the price of the products and the related delivery costs by credit card, bank transfer, PayPal, Google Pay, Apple Pay.
The charge on the customer’s credit card will only occur after the verification of the credit card data, the authorization of charge by the credit card issuer used by the customer, and the confirmation of the product’s availability by the Seller, when the order is ready to be processed.
In case charging the amounts due by the customer is impossible for any reason, the purchase will be automatically canceled and deleted.
12) CONCLUSION OF THE CONTRACT
The contract between the Seller and the customer is considered concluded when the customer receives confirmation that their order proposal, sent following the purchase procedure indicated on the Site, has been successfully completed, after verifying the product’s availability and charging the price on the customer’s credit card. The order proposal sent by the customer will be binding for the Seller only if the entire purchase procedure has been completed without errors reported by the Site.
The Seller reserves the right to partially fulfill the order in case one or more products ordered by the customer are not available. In this case, only the amount corresponding to the partially fulfilled order will be charged.
We are not responsible for any malfunctions dependent on the data transmission network operator.
We will email a summary of the general conditions, product information, price, payment methods, delivery costs, withdrawal conditions, and address.
The Seller assumes no responsibility for any problems caused by the network service provider.
In accordance with article 13 of the E-commerce Decree, at the time of order confirmation or execution of the contract, the Seller will send the Customer a summary of the General Conditions by email, including essential information on the Products purchased, detailed prices and payment methods, delivery costs, if present, instructions for exercising the right of withdrawal, the Seller’s address for submitting complaints, information on assistance services and commercial guarantees. The Customer is required to immediately verify the content of the communication and report any errors or omissions to the Seller.
13) INVALIDITY OF THE ORDER
Contrary to what is indicated in the previous paragraph 12, no order will be accepted by the Seller and no contract will be concluded if the Seller has reasonable and well-founded reasons to believe that the Customer:
intends to purchase the Products for purposes related to their own or another’s business or professional activity, in violation of what is established in paragraph 01 of these General Conditions;
does not have a real and genuine interest in purchasing the ordered Products; or
is abusing the right of withdrawal, as provided in the “REFUNDS AND RETURNS” paragraph that follows.
In such cases, the order proposal sent by the Customer will be considered invalid. The Seller will send the Customer an email communication attesting to the rejection of the order and the non-conclusion of the contract, also proceeding to cancel any charges or expenses on the Customer.
14) TRANSPORT AND DELIVERY
Products purchased on our site will be delivered to the shipping address indicated during the payment process. Delivery will require the signature of the customer or a legal representative at the time of receipt. Deliveries to post office boxes are not made.
At the time of product shipment, we will issue a receipt that will be sent to the order holder by email or mail, in accordance with current regulatory requirements. The receipt will be based on the information provided by the customer during the order and cannot be modified subsequently.
Any delivery costs will be borne by the customer and will be clearly indicated in the order form.
We will use a selected courier to make deliveries, from Monday to Friday, excluding holidays. However, we will not be responsible for any unforeseen delays or delays attributable exclusively to the courier. In case of complaints related to delivery delays, the customer must address the courier directly. Standard delivery times vary from 1 to 4 business days.
In case the customer wishes to cancel the order following a communication of delivery delay from us, we will proceed with the refund of the amount paid as soon as possible and in any case within 30 days from the receipt of the order cancellation communication.
The presence of the customer or their representative at the specified delivery address in the order is necessary at the time of product delivery. During delivery, the customer is required to check the following:
The number of packages delivered corresponds to what is indicated in the transport document; The packaging is intact, not damaged, nor wet or altered in any way, including the closing seals. Any damage to the packaging or products or any discrepancies in the number of packages or indications must be immediately reported in writing on the courier’s delivery document. Once the delivery document is signed without disputes, the customer cannot raise further complaints regarding the external characteristics of the delivered package.
We will send a confirmation email to the customer once the products have been shipped.
15) RETURNS AND REFUNDS
The Seller commits to ensuring the complete satisfaction of the Customer as the main interest of the company. The Customer has the right to exercise their right of withdrawal in accordance with the law and the company’s policies.
Pursuant to article 52 of the Consumer Code, the Customer has the right to withdraw from the contract within 14 days from the date of receipt of the Products purchased on the Site. It should be noted that the right of withdrawal is not applicable to perishable and/or deteriorable products as provided by law (art. 62 L. 27/12).
To exercise the right of withdrawal, the customer must send an email to info@organictruffles.it, indicating the desire to exercise the right of withdrawal pursuant to article 52 of the Consumer Code, the products for which they wish to exercise such right, and the order number communicated by the Seller at the time of purchase confirmation.
It should be noted that the right of withdrawal cannot be exercised if the Product is not intact, if the original packaging is missing or damaged, or if essential elements of the Product are missing. Furthermore, the right of withdrawal does not apply to highly perishable products that are at risk of altering or deteriorating rapidly (art. 62 L. 27/12).
In case of exercising the right of withdrawal, the Seller will provide a full refund of the price of the Products, provided that they are returned within 14 days from the exercise of the right of withdrawal, in intact conditions, not opened or consumed, accompanied by the original receipt.
The Seller reserves the right to refuse the return of Products that do not meet these requirements. Refunds will be made using the same payment method used for the purchase.
The costs of returning the Products are borne by the Customer and will not be reimbursed.
Each delivery will include simple instructions for returning the Products.
The Seller commits to refunding the Customer within 14 days from receiving the withdrawal communication pursuant to art. 54 of the Consumer Code. A notification email will be sent once the refund has been completed.
It is recommended to return the Products using a courier service and insuring the entire value of the goods. It is important to obtain a shipping number to track the return. The Seller will not be responsible for refunding or compensating for Products shipped by the Customer but not received due to loss, theft, or damage not attributable to the company.
If the Customer wishes to modify or cancel an order already placed, it is necessary to promptly send an email to info@organictruffles.it, before receiving the shipping confirmation. We will do our best to accommodate the request, however, once the Product has been shipped, the order cannot be canceled or modified.
Organic Truffles wishes to ensure the complete satisfaction of the Customer, representing it as a primary interest of the Company. The Customer may exercise their right of withdrawal not only according to the principles dictated by current regulations and in full respect of them but also by taking advantage of the facilities below indicated and developed by the Company.
16) WITHDRAWAL AND CANCELLATIONS
Pursuant to article 52 of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the reason, by returning the Products purchased on the Site within 14 (fourteen) days from the date of receipt of the Products. The withdrawal is excluded by law (art. 62 L. 27/12) for perishable and/or deteriorable products.
To exercise the right of withdrawal, the customer must send to the following address: info@organictruffles.it an email containing:
the expression of the intention to avail of the right of withdrawal pursuant to article 52 of the consumer code; the indication of the products for which the customer wants to exercise the right of withdrawal; the progressive order number communicated at the time of purchase confirmation; The Customer acknowledges and is aware that they cannot exercise the right of withdrawal in the absence of the essential condition of the integrity of the Product (packaging or its contents), in cases where the original packaging containing the purchased Product is missing or is damaged, or essential elements of the Product are missing. The Customer acknowledges that the right of withdrawal cannot be exercised for highly perishable Products that, due to their consistency and nature, are at risk of altering or deteriorating rapidly (art. 62 L. 27/12).
In case of exercising the right of withdrawal, the Seller will refund the full price of the Products provided that they are returned by the Customer within 14 days from the exercise of the right of withdrawal unopened, not consumed, and accompanied by the original receipt.
The Seller reserves the right to refuse the return of Products that do not comply with these requirements. Refunds will be made using the same payment method used for the purchase.
The costs for returning the Products are borne by the Customer; any expenses incurred by the Customer for the return will not be refundable.
Each delivery will contain easy instructions for returning the Products.
The Seller commits to refunding the Customer without undue delay and in any case within 14 days from the date of receipt by the same of the communication of withdrawal from the contract pursuant to art. 54 Consumer Code; and will send an email notification once the refund has been made.
It is recommended to ship the Products to be returned using a courier service and insuring the entire value of the goods. It is important to obtain a shipping number to be able to track the shipment. The Seller will not be responsible for the refund or compensation of Products shipped by the Customer but never received due to loss, theft, or damage not attributable to the Seller.
If the Customer wishes to modify or cancel an order already sent, it is necessary to promptly send an email to info@organictruffles.it, before receiving the shipping confirmation. We will do our best to satisfy the Customer’s request. However, once the Product has been shipped, the order cannot be canceled or modified. It is possible to return the shipped Products, referring to the provisions on the right of withdrawal described above.

Organic Truffles.it guarantees the authenticity of all Products purchased on the Site.
The “Organic Truffles” brand, as well as all figurative and non-figurative trademarks, service marks, present on the Products, accessories and/or related packaging, registered or unregistered shape trademarks, as well as all illustrations, images, and logos protected by copyright, and more generally, all intellectual property rights relating to the Products are and will remain the exclusive property of the Seller. The information, images, photographs, trademarks, and all elements and materials available on this Site are and will remain the exclusive property of the Seller. Therefore, reproduction, total or partial (except for personal and non-commercial use), distribution, publication, transmission, modification, in whole or in part, as well as the sale of the information, images, photographs, trademarks, products and, in general, the elements and materials present on this Site are expressly prohibited.
These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws.
For disputes arising from the interpretation, validity, and/or execution of these General Conditions, the territorial jurisdiction unconditionally will be that of the judge of the place of residence or domicile of the Customer/consumer.
